BUSINESSES: Sponsoring a foreign worker

In Canada, businesses can sponsor foreign workers through various immigration programs and streams to address labor shortages or hire skilled employees from abroad. The most common programs for sponsoring foreign workers include:

  1. Temporary Foreign Worker Program (TFWP): This program allows Canadian employers to hire foreign workers to fill temporary labor shortages when qualified Canadians or permanent residents are not available. Employers must obtain a positive Labor Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC) to hire a foreign worker under this program.

  2. International Mobility Program (IMP): The IMP includes various streams and categories, such as the Intra-Company Transfer Program, which allows companies to transfer employees from their foreign branches to Canada, and the International Mobility Program – Open Work Permit, which allows spouses and common-law partners of skilled workers and international students to work in Canada.

  3. Provincial Nominee Program (PNP): Many provinces and territories in Canada have their own PNP streams, some of which are designed to attract and retain foreign workers with specific skills and qualifications. These programs may offer nomination to foreign workers for permanent residence, provided they meet the eligibility criteria.

  4. Express Entry: The Express Entry system is a points-based immigration system that includes the Federal Skilled Worker Program, Federal Skilled Trades Program, and Canadian Experience Class. Employers can hire foreign workers who are already in Canada and have valid work permits, and these workers may be eligible to apply for permanent residence through Express Entry.

  5. Caregiver Programs: Employers can also hire foreign caregivers (such as live-in caregivers) to provide in-home care for children, seniors, or individuals with disabilities. These caregivers may be eligible to apply for permanent residence after fulfilling the required work experience.

 

To sponsor a foreign worker, employers typically need to meet certain requirements, including demonstrating that they have made efforts to hire Canadians or permanent residents first and that the employment offer is genuine. Additionally, foreign workers must meet specific eligibility criteria, such as having the required skills and qualifications for the job.
