LMIA-Exempt TFWP

LMIA is a document that an employer in Canada usually needs to obtain to demonstrate that they have tried to hire a Canadian citizen or permanent resident for the job but were unable to find a suitable candidate. However, there are several LMIA-exempt categories for temporary foreign workers. Here are some common ones:

  1. International Mobility Program (IMP): Under the IMP, certain foreign workers can apply for a work permit without the need for an LMIA. This includes workers covered under international trade agreements (e.g., NAFTA, CETA), spousal work permits, and some workers with Canadian interests (e.g., significant benefits to Canada).

  2. Intra-Company Transferees: Employees of a foreign company who are being transferred to a Canadian branch, subsidiary, or affiliate may be eligible for an LMIA-exempt work permit.

  3. Free Trade Agreements: Certain professionals, such as those under NAFTA or CETA (Comprehensive Economic and Trade Agreement), can get a work permit without an LMIA.

  4. Post-Graduation Work Permit: International students who have graduated from eligible Canadian institutions may obtain an open work permit without the need for an LMIA.

  5. Open Work Permits for Spouses or Common-Law Partners: Spouses or common-law partners of some foreign workers and international students can apply for an open work permit without the LMIA requirement.

  6. Refugee Claimants: Asylum seekers who have applied for refugee status in Canada may be eligible for work permits while their claims are being processed.

  7. Humanitarian and Compassionate Grounds: In some cases, individuals in Canada who are applying for permanent residence on humanitarian and compassionate grounds may be eligible for a work permit without an LMIA.

  8. Research and Academic Exchanges: Researchers, visiting professors, and certain academics may be eligible for LMIA-exempt work permits.

  9. Other Categories: There are various other LMIA-exempt categories, including certain caregivers, live-in caregivers, and others.
